The District of Columbia Circuit Court of Appeals has temporarily enjoined the NLRB’s rule requiring the posting of employee rights, which had been scheduled to take effect on April 30, 2012. The poster requirement has caused a flurry of controversy over the past months resulting in several deadline extensions and numerous challenges in court. The temporary injunction ordered by the D.C. Circuit Court of Appeals followed the district court’s ruling that invalidated the enforcement mechanisms of the posting requirement. There is currently no new deadline for the posting requirement, but the NLRB still believes it has the authority to issue and enforce the rule.
