| Employment Law This practice group is prepared to respond to the ever expanding array of legal issues that surround the employer-employee relationship. Firm lawyers who concentrate in this area represent a growing list of employers of all sizes, including national corporations as well as many of Iowa's largest and most progressive employers. Clients are advised with respect to preventive law as well as being provided with experienced representation on matters in litigation. Preventive services include drafting and review of personnel policies and employee handbooks, preparation of employment and severance agreements, investigation of employee complaints and employee education and training. In addition, this practice group advises clients on employment law issues and problem situations which arise in the day-to-day operation of their businesses. In this respect, the group’s goal is to assist its clients in identifying and avoiding troublesome issues before they give rise to litigation. If litigation is initiated, the practice group is prepared to vigorously pursue the client’s interests. This practice group also contains a team dedicated to workers’ compensation and all of the interrelated issues pertaining to workers with health issues. The team has extensive experience in defending workers’ compensation claims in litigation and at the pre-litigation counseling and investigation stages. Team members work with union and non-union employers, self-insured employers (self-administered and those using third-party administrators), and insurance carriers. This team also has expertise defending against bad faith claims and in addressing Medicare issues which arise at the time of settlement of workers’ compensation claims. Members of this practice group have represented clients extensively in state and federal court at both trial and appellate levels and before many national, state and local administrative agencies. Litigated issues include claims arising under Title VII, Iowa's Civil Rights Act, the Age Discrimination in Employment Act, the Americans with Disabilities Act, the Family Medical Leave Act, OSHA, the Fair Labor Standards Act, Wage Payment Acts, and the National Labor Relations Act, as well as claims alleging breach of express and implied contract, violations of public policy, defamation, intentional infliction of emotional distress, promissory estoppel, interference with contract, invasion of privacy and other related claims.
